Terms of Service
These Terms of Service (“Terms”) are an agreement between you and BandUp (“BandUp”, “we”, “us”) governing your use of the BandUp mobile application and this website (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
BandUp is a practice tool that runs AI-powered mock speaking exams in the style of IELTS and provides estimated band scores and feedback. The scores, feedback and study suggestions are automated practice estimates for your own learning only. They are not official IELTS results, are not produced or endorsed by any official IELTS organisation, and do not guarantee any particular outcome on a real exam.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, such as 16 in parts of the EEA) to use the Service. By using the Service you confirm that you meet this requirement and that the information you provide is accurate.
3. Your account
You need an account to use the Service. You are responsible for keeping access to your account (and the email or third-party sign-in you use) secure, and for activity that occurs under your account. Tell us promptly if you believe your account has been used without authorisation.
4. Free and premium plans
We offer a free tier and paid premium options. The free tier allows a limited amount of practice each day (for example, one short mock exam per day) with a preview of the report. Premium plans unlock full-length mock exams, detailed reports and additional features, subject to fair-use limits that we may apply to keep the Service reliable and prevent abuse. We may change the features, limits or availability of any plan.
5. Subscriptions, billing & renewals
- Premium is offered as a recurring subscription (for example, monthly or three-monthly) and/or as a one-time purchase that unlocks a single full report. Current prices are shown in the app before you buy.
- All purchases are processed by the app store from which you downloaded the app (for example, Google Play), through its in-app billing system. Your payment is charged to your app-store account.
- Auto-renewal: subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your app-store account is charged for renewal within the 24 hours before the period ends.
- You can view, manage and cancel subscriptions in your app-store account settings at any time. Cancelling stops future renewals; it does not shorten the period you have already paid for.
6. Cancellations & refunds
Because purchases are handled by the app stores, refunds are governed by the policy of the store you purchased through, together with any mandatory consumer rights in your country. Requests for refunds are generally made to, and decided by, that app store. You can cancel a subscription at any time as described above.
7. Acceptable use
You agree not to:
- use the Service for anything unlawful, or in violation of these Terms;
- reverse engineer, scrape, or attempt to extract our prompts, models or source code, except where such restriction is prohibited by law;
- interfere with, overload, or circumvent the security, rate limits or fair-use controls of the Service;
- resell, share or commercially exploit the Service or your account without our permission;
- upload content that infringes others’ rights or that you have no right to record or submit.
8. Your content
“Your content” means the voice recordings and answers you submit and the transcripts, scores and feedback generated from them. You keep ownership of your content. You grant BandUp a limited licence to host, process and use your content solely to operate, secure and improve the Service and to provide your results, as described in our Privacy Policy. You are responsible for the content you submit and confirm you have the right to submit it.
9. Intellectual property
The Service, including its software, design, text and branding, is owned by BandUp or its licensors and is protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or content except to use the Service as permitted. IELTS is a registered trademark of the British Council, IDP: IELTS Australia and Cambridge University Press & Assessment; BandUp is independent and not affiliated with or endorsed by them.
10. Disclaimers
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, or that the estimated band scores or feedback will match the result you would receive on an official exam. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
11. Limitation of liability
To the fullest extent permitted by law, BandUp will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, opportunity or profits, arising from your use of (or inability to use) the Service. To the extent we are found liable, our total liability is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 20. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
12. Termination
You may stop using the Service at any time and delete your account (see Account & Data Deletion). We may suspend or terminate your access if you breach these Terms, misuse the Service, or where required by law. Sections that by their nature should survive termination (such as intellectual property, disclaimers and limitation of liability) will continue to apply.
13. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws rules, except where the mandatory consumer-protection laws of your country of residence provide you with additional protections that cannot be waived.
